What is title insurance?

Title insurance is a guarantee of a property's marketable title. In most instances, the lender requires a Loan Policy of Title Insurance to protect them from a loss caused by a defect in the title of their collateral. It protects them from anything that might be overlooked by a thorough title search as well as items that can not be found by searching the public records, such as forgeries, incompetent parties, survey errors and other of-record defects.

Does title insurance protect the property owner?

Although the Loan Policy, required by most lenders only protects their interest, an Owner's Policy is available that will similarly cover the property owner. The Owner's Policy can be purchased simultaneously with the Loan Policy for a substantial savings to the purchaser.
